Terms of Service for BlindFish
Welcome to BlindFish (“BlindFish,” “we,” “our,” or “us”). By accessing or using the BlindFish application, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the application.
1. Description of Service
BlindFish is a content management tool that allows users to:
- Import their TikTok video library into a centralized dashboard.
- Review and approve videos they wish to retain.
- Connect authorized Facebook Pages.
- Schedule and automatically publish approved content to those Pages.
BlindFish only performs actions that you explicitly authorize.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms.
By using BlindFish, you represent that:
- The information you provide is accurate.
- You own or have the necessary rights to the content you manage through the application.
- You have authority to manage any Facebook Pages you connect.
3. User Responsibilities
You agree to:
- Keep your account credentials secure.
- Maintain accurate account information.
- Use BlindFish in compliance with all applicable laws and regulations.
- Follow the Terms of Service and Community Standards of Facebook, TikTok, and any other connected platforms.
You are solely responsible for the content you upload, schedule, or publish.
4. Prohibited Uses
You may not use BlindFish to:
- Violate any law or regulation.
- Infringe upon another person’s intellectual property rights.
- Publish unlawful, fraudulent, defamatory, or abusive content.
- Attempt to gain unauthorized access to our systems.
- Interfere with the operation or security of the service.
- Circumvent restrictions imposed by Facebook, TikTok, or other connected platforms.
We reserve the right to suspend or terminate accounts engaged in prohibited activities.
5. Intellectual Property
BlindFish and all associated software, branding, logos, designs, and functionality are owned by BlindFish or its licensors and are protected by applicable intellectual property laws.
These Terms do not grant you ownership of the BlindFish platform.
You retain ownership of the content you upload or manage through the application.
6. Third-Party Services
BlindFish integrates with third-party platforms including Facebook and TikTok.
Your use of those services remains subject to their respective terms and privacy policies.
BlindFish is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or TikTok unless explicitly stated.
7. Availability of Service
We strive to provide reliable service but do not guarantee uninterrupted availability.
BlindFish may occasionally experience maintenance, updates, outages, or interruptions beyond our control.
We may modify, suspend, or discontinue features at any time.
8. Disclaimer of Warranties
BlindFish is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The service will always be available.
- Scheduled posts will always publish successfully.
- Third-party platforms will maintain compatibility with BlindFish.
9. Limitation of Liability
To the maximum extent permitted by law, BlindFish and its owners, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the service.
Our total liability for any claim related to the service shall not exceed the amount you paid to BlindFish during the twelve (12) months preceding the claim, or USD $100 if no payment has been made, whichever is greater.
10. Termination
You may stop using BlindFish at any time.
We may suspend or terminate access to the service if you violate these Terms or if continued access would expose BlindFish or its users to legal, operational, or security risks.
Upon termination, your right to use the service immediately ends.
11. Privacy
Your use of BlindFish is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
12. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, we will update the “Last Updated” date above. Continued use of BlindFish after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
